In December the Scottish Government announced a temporary ban on tenants being evicted over the Christmas/New Year period. The ban was due to end on 22 January.
As a result of the continued rise in coronavirus cases caused by the new variant of the virus, the government has announced that it will extend the eviction ban. In areas subject to level 3 and 4 restrictions it will continue until at least 31 March in order to ensure tenants are able to remain in their homes during this time.
Landlords can still serve notice and apply to the tribunal for an eviction order if the tenant doesn’t leave. However, the ban on evictions means that eviction orders issued by the tribunal can’t currently be enforced within areas subject to level 3 or 4 restrictions.
The regulations will be reviewed every 21 days, and will continue to include exemptions in relation to the most serious circumstances – such as illegal occupation, antisocial behaviour, and criminal behaviour including domestic abuse.
